Serving Utah since 1996, the Utah Insurance Receivers Office assists the Utah Insurance Commissioner in managing and resolving the affairs of insolvent insurance companies.

Our mission is to protect policyholders, creditors, and the public by ensuring that each receivership is handled efficiently, transparently, and in accordance with Utah law.

  • Acting under the direction of the Insurance Commissioner, the Special Deputy Liquidator:

    -Takes control of the insolvent company’s assets

    - Manages communications with creditors, policyholders, and guaranty associations

    - Distributes available funds in accordance with Utah’s statutory priority of claims.

    If you believe your policy is covered by a state guaranty association, contact the deputy liquidator handling the specific receivership for more information.

  • Once a company has been placed into a delinquency proceeding, notices are sent to all persons who have had dealings with the insurance company. Notices of the proceedings also include a form to send back to the company identifying any claim that may be outstanding against the company and setting forth rules to assure consideration of that claim. There is a time limit on how long a person has to file a claim.

  • After all assets are collected, claims not covered by guaranty associations are paid according to the priority order outlined in Utah Code §31A-27a-701.

    Payments are distributed on a pro-rata basis according to the funds available within the estate.
